Regulations for the return / replacement of goods of inadequate quality

     In case of detection of low-quality Goods and /or Goods in incomplete configuration, the Buyer is obliged to notify the Supplier within 2 (Two) working days from the moment of receipt of the Goods from the transport organization or upon pickup of the Goods, as well as during the warranty period (in case of detection of low-quality Goods), draw up a complaint report on the detection of defects, take a photo/video fixation and send to the Supplier (295000, RK, Simferopol, ul. im. gazeta Krymskaya Pravda, house 6B, lit. Ah, room 23.)
     At the same time, in the notification of the discovery of low-quality or incomplete Goods, the Buyer is obliged to specify:
a) product name, date and invoice number, details of the transport document;
b) defects found in the Product;
d) the quantity of products of inadequate quality or incomplete products;
e) if the defect is visible visually, then it is photographed and photos are attached to the notification.
     Upon receipt of a notification from the Buyer about the discovery of substandard Goods, the Supplier, within the time agreed with the Buyer, checks the Goods by drawing up a complaint act, which specifies a list of shortcomings, the reasons for their appearance.
     The Parties have established that the basis for making claims to the Supplier on the quality of the Goods is an act of complaint drawn up by the parties to the Contract, in which all the necessary data must be recorded to identify the Goods of inadequate quality.
     In the absence of such an act, the fact of delivery of Goods of inadequate quality or delivery of incomplete Goods is considered unproven.
     The act must be signed by all persons who participated in the inspection of the Goods.
To participate in the acceptance of products, persons who are competent (by type of work, education, work experience) in determining the quality and completeness of the products to be accepted should be allocated.
    If, during the acceptance of the Goods with the participation of representatives of all interested parties, an indisputable shortage of Goods and/or the indisputable presence of defects caused by the Supplier is revealed, the decision taken by the Parties based on the results of the quality control of the Goods should be indicated in the complaint Act.
     In case of detection of low-quality Goods, and if the identified defects prevent the use of the Goods for their intended purpose and do not comply with the requirements for the Goods agreed by the parties in the contract (specifications), the Buyer has the right to demand from the Supplier:
- replacement / additional delivery of the Goods in accordance with the procedure and terms provided for by these Regulations; - a proportionate reduction in the cost of the Goods;
- reimbursement of their expenses for the elimination of defects of the Goods;
- completion of the goods in a reasonable time.
     In case of replacement of Goods of inadequate quality with similar Goods, the Supplier ensures the shipment of Goods of proper quality within 40 (forty) working days from the date of signing by the parties of the complaint act.
     The Parties may also agree on reimbursement by the Supplier of the Buyer's documented costs for the elimination of the detected deficiencies. In case of non-completion of the Goods due to the fault of the Supplier, the latter is obliged to complete the Goods within 21 (twenty-one) working days from the moment the parties sign the complaint act.
     If a decision is made to return the Goods, a corresponding note is made about this in the complaint act, and the Supplier takes the Goods within 10 (Ten) working days. The funds for the delivered low-quality Goods are returned by the Supplier within 14 (fourteen) working days, from the moment the parties sign the complaint act.
     If the fault of the transport company appointed by the Buyer for the delivery of the Goods is revealed, the Buyer has the right to apply to it in a recourse procedure with a claim to reimburse the costs of reimbursement for the elimination of deficiencies.
     If the Buyer is located in another region and the departure of the Supplier's representative for the preparation of the complaint act is difficult, the Supplier notifies the Buyer about it. In this case, the Buyer draws up a unilateral complaint act with a description of the shortcomings and together with it sends the Goods to the Supplier for inspection, within 5 (Five) working days from the date of drawing up the Act.
     After receiving the low-quality Goods, the Supplier determines an expert organization that will have to conduct an examination of the low-quality Goods and indicate the causes of the defect with the determination of the guilty party.
     Within 5 (Five) working days from the date of receipt of the expert opinion, the Supplier sends it to the Buyer.
     In case of identification of the Buyer's fault, the Buyer, within 5 (Five) working days from the date of receipt of the relevant notification from the Supplier, reimburses the Supplier for the costs of the examination. In this case, the Goods are considered to be delivered of proper quality.
     The Regional Buyer is obliged to take it out of the Supplier's warehouse within 15 (Fifteen) working days from the date of receipt of the Supplier's notification.
     By agreement of the parties, the Supplier can repair the Goods for the Buyer for a fee, and an Additional Agreement to the Contract is drawn up. In the event of an indisputable material violation of the requirements for quality and /or for the complete set of Goods, the provisions of these regulations apply.
     By signing this agreement, the Parties agree that in case of non-compliance with the terms of these Regulations, any claims about the quality and quantity of the delivered Goods are not subject to satisfaction.

     Attention! In order to avoid damage to the goods during transportation, it is recommended to order additional packaging from the transport company (pallet board, crate), since when sending the goods, the carrier has the right to refuse the sender if the packaging does not meet the transportation requirements.
In case of damage to the goods during transportation, the claim should be sent to the carrier.
